1. Acceptance of Terms

Welcome to CrypAlgo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CrypAlgo ("we", "us", or "our") governing your access to and use of our cryptocurrency trading indicator service for TradingView.

By accessing our website, subscribing to our service, or using our TradingView indicator, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to modify these Terms at any time. Material changes will be notified via email and/or prominent notice on our website. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

2. Service Description

CrypAlgo provides a proprietary algorithmic trading indicator designed exclusively for use on the TradingView platform. Our service includes:

• AI-Powered Indicator: Access to our proprietary TradingView indicator that generates buy and sell signals for cryptocurrency trading
• Real-Time Signals: 24/7 automated signal generation based on advanced technical analysis and machine learning algorithms
• Alert Notifications: Ability to set up TradingView alerts for instant notifications
• Customer Support: Email support for technical issues and account management (response times vary by subscription tier)
• Educational Resources: Access to tutorials, guides, and best practices documentation

Our service is provided on a subscription basis with three plan options: Monthly, Quarterly, and Lifetime. Each plan grants access to the same core indicator functionality, with varying billing cycles and support levels.

Important: CrypAlgo is a tool to assist with trading decisions. It does not guarantee profits and should not be considered financial advice. All trading involves substantial risk of loss.

3. Eligibility and User Responsibilities

3.1 Age and Legal Capacity

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our Services. By using CrypAlgo, you represent and warrant that:

• You are at least 18 years old
• You have the legal right and authority to enter into this agreement
• You are not prohibited from using our Services under applicable laws
• All information you provide is accurate, current, and complete

3.2 TradingView Account Requirement

To use CrypAlgo, you must have an active TradingView account. You are responsible for:

• Creating and maintaining your TradingView account
• Complying with TradingView's Terms of Service
• Providing your accurate TradingView username during subscription
• Any fees associated with your TradingView account (separate from CrypAlgo fees)

3.3 Trading Knowledge and Risk

You acknowledge that:

• Cryptocurrency trading involves substantial risk and is not suitable for all investors
• You have sufficient knowledge and experience to evaluate the risks of cryptocurrency trading
• You will only trade with funds you can afford to lose
• Past performance of signals is not indicative of future results
• You are solely responsible for all trading decisions and their outcomes

4. Account Registration and Security

4.1 Account Creation

To subscribe to CrypAlgo, you must provide accurate and complete information including:

• Your full legal name
• Valid email address
• Phone number
• Billing address
• Exact TradingView username
• Payment information

You agree to keep this information accurate and up-to-date. Failure to provide accurate information may result in suspension or termination of your account.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use strong passwords and keep them secure
• Not share your account with others
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

4.3 Account Suspension

We reserve the right to suspend or terminate your account if we suspect:

• Fraudulent activity or payment issues
• Violation of these Terms
• Sharing account access with unauthorized parties
• Use of the service for illegal purposes
• Abusive behavior toward our staff or other users

5. Subscription Plans, Billing, and Cancellation

5.1 Subscription Plans

CrypAlgo offers three subscription plans:

• Monthly Plan ($25/month): Billed monthly, cancel anytime
• Quarterly Plan ($50/3 months): Billed every 3 months, priority support, cancel anytime
• Lifetime Plan ($199 one-time): One-time payment, lifetime access, VIP support, non-refundable

All prices are in U.S. Dollars (USD) and are subject to change with 30 days' notice to existing subscribers.

5.2 Billing and Payment

By subscribing, you authorize us to charge your payment method:

• An initial charge for your first billing period
• Recurring charges for Monthly and Quarterly plans at the start of each billing cycle
• All payments are processed securely through Stripe
• You are responsible for keeping your payment information current
• Failed payments may result in service suspension

5.3 Automatic Renewal

Monthly and Quarterly subscriptions automatically renew unless cancelled before the renewal date. You will be charged at the then-current rate for your plan. We will send a renewal reminder email before each billing cycle.

5.4 Cancellation Policy

You may cancel your Monthly or Quarterly subscription at any time:

• Cancellations take effect at the end of your current billing period
• You retain access until the end of the paid period
• No partial refunds are provided for unused time
• Cancelled subscriptions can be reactivated at any time
• Lifetime plans cannot be cancelled (one-time payment, non-refundable)

5.5 No Refund Policy

ALL SALES ARE FINAL. Due to the nature of digital products and instant access to our proprietary indicator, we do not offer refunds under any circumstances. This applies to all subscription plans including Monthly, Quarterly, and Lifetime. Please review our Refund Policy for complete details.

5.6 Price Changes

We reserve the right to change our pricing. Price changes for existing subscribers will:

• Be communicated at least 30 days in advance via email
• Take effect on your next billing cycle after the notice period
• Give you the option to cancel before the new rate applies
• Not affect Lifetime plan holders (locked-in price)

6. TradingView Integration and Access

6.1 Indicator Access

After successful payment and admin approval (typically 12-24 hours):

• You will receive an email with a TradingView invite link
• The CrypAlgo indicator will appear in your TradingView "Invite-only scripts" section
• You can add the indicator to any cryptocurrency chart on TradingView
• Access is tied to your specific TradingView username provided during subscription

6.2 TradingView Username Requirements

You must provide your exact TradingView username during subscription:

• Username changes cannot be made after admin approval without contacting support
• Incorrect usernames will delay access until corrected
• You cannot transfer your CrypAlgo access to a different TradingView account without our permission
• One CrypAlgo subscription = one TradingView username only

6.3 TradingView Platform Dependency

CrypAlgo operates exclusively on the TradingView platform:

• We are not affiliated with, endorsed by, or sponsored by TradingView
• TradingView's availability, features, and policies are beyond our control
• We are not responsible for TradingView outages, changes, or discontinuation of services
• You must comply with TradingView's Terms of Service when using CrypAlgo
• TradingView may have separate fees (e.g., for Pro accounts with more alerts)

6.4 Indicator Updates

We regularly update and improve our indicator:

• Updates are automatically applied to all active subscribers
• We reserve the right to modify indicator logic, features, and performance
• Major changes will be communicated via email
• Updates do not entitle you to refunds if you disagree with changes

7. Prohibited Uses and Restrictions

You agree NOT to:

• Reverse Engineer: Attempt to decompile, reverse engineer, or extract the source code of our indicator
• Redistribute: Share, sell, rent, lease, or distribute access to CrypAlgo to third parties
• Account Sharing: Share your TradingView access or CrypAlgo credentials with others
• Resale: Resell signals, screenshots, or recommendations derived from CrypAlgo
• Automated Access: Use bots, scrapers, or automated tools to access our services without permission
• System Interference: Attempt to interfere with, disrupt, or hack our services or infrastructure
• Illegal Activity: Use CrypAlgo for any illegal purposes, fraud, or money laundering
• False Claims: Make misleading claims about CrypAlgo's performance or guarantees
• Competitive Analysis: Use CrypAlgo to build competing products or services

Violation of these restrictions may result in immediate termination of your account without refund and potential legal action.

8. Intellectual Property Rights

8.1 Our Ownership

CrypAlgo, including our indicator code, algorithms, brand name, logo, website content, and all related intellectual property, are owned by us and protected by copyright, trademark, and trade secret laws. All rights not expressly granted are reserved.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the CrypAlgo indicator on TradingView for personal trading purposes
• Use our educational materials for your own learning
• Access our website and customer support

This license terminates upon cancellation or termination of your subscription.

8.3 Trademarks

"CrypAlgo" and our logo are trademarks. You may not use our trademarks without prior written permission.

8.4 User Feedback

If you provide us with feedback, suggestions, or ideas about CrypAlgo, you grant us a perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback into our services without compensation or attribution.

9. Disclaimers and Warranties

9.1 No Financial Advice

9.2 No Guarantee of Profits

We make NO GUARANTEES OR WARRANTIES about:

• Profitability or trading success
• Signal accuracy or reliability
• Specific returns or performance results
• Winning percentage or risk-reward ratios

Past performance is not indicative of future results. Cryptocurrency markets are highly volatile and unpredictable. You may lose all of your invested capital.

9.3 "As-Is" Service

CrypAlgo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy, completeness, or reliability of information
• Freedom from viruses or harmful components

9.4 Third-Party Dependencies

We are not responsible for:

• TradingView platform availability, errors, or changes
• Cryptocurrency exchange outages or errors
• Internet connectivity issues
• Payment processor (Stripe) issues
• Market conditions, volatility, or black swan events

9.5 Market Risks

You acknowledge and accept the following risks:

• Cryptocurrency trading is speculative and involves extreme risk
• Prices can fluctuate wildly and unpredictably
• Markets can be manipulated by large players ("whales")
• Exchanges can be hacked, frozen, or shut down
• Regulations can change suddenly, affecting market access
• Technical analysis and algorithms cannot predict all market movements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Trading losses or missed opportunities
• Loss of goodwill or reputation
• Service interruptions or delays
• Cost of substitute services
• Emotional distress or mental anguish

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless CrypAlgo, its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use or misuse of our Services
• Your trading activities and decisions
• Your violation of these Terms
• Your violation of any third-party rights, including TradingView's terms
• Your violation of applicable laws or regulations
• Any false or misleading information you provide
• Unauthorized use of your account by others due to your negligence

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

12. Termination and Suspension

12.1 Termination by You

You may cancel your subscription at any time:

• Monthly and Quarterly plans: Cancel anytime, access continues until end of billing period
• Lifetime plan: Cannot be cancelled (one-time payment, permanent access unless we terminate)

12.2 Termination by Us

We may suspend or terminate your access immediately, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Payment failures or chargebacks
• Abusive behavior toward staff or users
• Any reason at our sole discretion

12.3 Effects of Termination

Upon termination:

• Your TradingView indicator access will be revoked
• You will no longer receive signals or support
• No refunds will be provided (see Refund Policy)
• All licenses granted to you terminate
• Provisions that by their nature should survive (disclaimers, limitations, indemnification) remain in effect

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions. Claims may not be joined or consolidated unless we agree in writing.

13.4 Informal Resolution

Before initiating arbitration, you agree to first contact us at legal@cryptalgo.com to attempt an informal resolution. We commit to working in good faith to resolve disputes amicably.

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CrypAlgo regarding use of our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, or strikes.

14.6 Language

These Terms are written in English. Any translations are provided for convenience only, and the English version shall prevail in case of conflict.
